The official manufacturer's warranty of Boilte applies to all goods supplied.
Terms and definitions
- "Heat Exchange Circuit (HEC)" – the structural core of the boiler, comprising the combustion chamber, the heat transfer surfaces (furnace and flue tubes, headers) and the principal welded joints of those elements, all of which operate under pressure.
- "Lifetime Warranty on the HEC" – the obligation of the Supplier in respect of the HEC, valid throughout the Service Life of the Equipment as stated in the data sheet of the goods purchased, subject to the unconditional compliance of the Buyer with every condition of this Section.
- "Service Contract" – a separate agreement for scheduled maintenance, concluded with a service partner authorised by the Supplier.
- "Digital Twin" – the cloud-based telemetry monitoring system of the Supplier, which forms a mandatory part of the scope of supply.
Limitation and allocation of liability
Scope of the warranty obligations
The Lifetime Warranty covers ONLY the physical integrity of the main Heat Exchange Circuit, that is to say the absence of burn-through, cracking and corrosion damage in the parent metal, provided that the water-side operating conditions are observed.
On the Heat Exchange Circuit
- a) Lifetime Warranty – applies to operation on gaseous or light liquid fuels (diesel oil, light furnace oil) as stated in the Technical Specification. The warranty period is equal to the Service Life of the Equipment.
- b) Reduced Warranty of 12 months – applies unconditionally and automatically to operation on heavy fuels (heavy fuel oil, crude oil, waste oils, dark furnace oils and other viscous hydrocarbons). The warranty period is 12 (twelve) months from the date on which the Commissioning Certificate is signed, and in no event more than 18 (eighteen) months from the date of dispatch. This condition applies where heavy fuel is named as the primary or the stand-by fuel in the Technical Specification or in the project documentation.
On components and auxiliary equipment
- a) The warranty period for burner units, pump sets, control units and controllers manufactured by the Supplier is 24 months from the date of commissioning.
- b) The warranty period for auxiliary equipment and third-party components (shut-off valves, pumps, instrumentation sensors, control panels and similar items) is 12 months from the date of dispatch from the warehouse of the Supplier. In respect of such equipment the liability of the Supplier is limited to the obligation to replace the item with an equivalent one where a latent manufacturing defect is established.
1.2.4. All warranty periods, other than the period stated in clause 1.2.2 b, run from the date on which the Commissioning Certificate is signed by the Buyer and by an authorised representative of the Supplier.
Conditions for the validity of the Lifetime Warranty on the Heat Exchange Circuit
The warranty obligations of the Supplier are valid in full only where the Buyer complies simultaneously and continuously with the following conditions:
- Correct commissioning
- The Buyer observes strictly all the rules for installation, commissioning, operation and maintenance set out in the Operating Manual for the Equipment. Commissioning work has been carried out by a partner authorised by the Supplier.
- A Service Contract in force
- A comprehensive Service Contract has been concluded, and is being paid for, with the service organisation of the Supplier or with a partner authorised by it. All scheduled maintenance has been performed on time and is evidenced by the corresponding certificates.
- The Digital Twin in operation
- The Equipment is permanently connected to the Digital Twin system. Telemetry data constitute the primary and conclusive evidence of compliance with, or breach of, the operating conditions.
- Compliance with the operating regulations
- The Equipment is operated in strict accordance with the Operating Manual, using only the approved fuels and an approved heat transfer medium whose parameters meet the specified limits. Feed and system water is treated to parameters no worse than those given in the data sheet (hardness, pH, oxygen content and so on). Scheduled maintenance is performed by specialists authorised by the Supplier or by specialists trained by the Supplier. Each maintenance visit must be confirmed by an entry in the Maintenance Log bearing the signature and stamp of the organisation that carried out the work. The installation and upkeep of water treatment plant is mandatory.
- No unauthorised intervention
- No unauthorised modifications or repairs have been carried out on the Equipment and no components not approved by the Supplier (including burner units) have been fitted. Only original consumables, spare parts and software, or items approved by the Supplier in writing, have been used.
Exclusions from the warranty obligations
The Supplier accepts no liability, and the warranty does not apply, in respect of defects arising from:
- Breach of any of the conditions set out in the preceding section.
- Firing regime
- The use of off-specification or unsuitable fuel or heat transfer medium.
- Temperature regime and operation
- Operation in excess of the rated parameters stated in the data sheet, whether pressure, temperature or output.
- Intervention in the design
- The acts of third parties, accidents, force majeure events, or wilful misconduct or gross negligence on the part of the Buyer.
- Normal wear
- Thinning of the heat exchanger walls resulting from normal operational wear after the rated service life has elapsed.
- Scale and deposits
- The presence of scale on the internal surfaces of the heat exchanger, as recorded when the boiler is opened up. Scale is evidence of a breach and voids the warranty in full.
- Overheating of the metal
- Distortion or change in the structure of the metal, including overheating damage, caused by operation with scale present, by loss of water or by incorrect burner settings.
- Corrosion
- Pitting, oxygen or intergranular corrosion caused by an aggressive medium or by extended idle periods without preservation of the boiler.
- Mechanical damage
- Cracking and failure resulting from water hammer, freezing of water in the boiler or external impact.
- Force majeure
- Fire, flood, hostilities and other events beyond reasonable control.
The right of the Supplier to audit
The Supplier is entitled to carry out an on-site audit of the operating conditions of the Equipment once in each calendar year at its own expense. Where serious breaches are identified, the Supplier notifies the Buyer and allows 30 days for them to be remedied. Failure to remedy the breaches is grounds for terminating the Lifetime Warranty in its entirety.
